Definitions

The “Customer” refers to the person or company purchasing the goods.

The “Goods” refer to the items supplied by Webfittings to the Customer under the contract between them.

Any goods ordered are taken with the understanding that the Customer has fully committed and is subject to Webfittings’ Terms and Conditions.

1) Prices

  1. Prices quoted are inclusive of VAT.
  2. Webfittings reserves the right to alter prices without prior notice. We are not bound by any non-written price quote.
  3. Written quotations are valid for four weeks.

2) Use of Products

  1. It is the responsibility of the purchaser to determine the suitability of the product for their specific application.
  2. Webfittings accepts no liability for any loss or damage resulting from the use of our products.
  3. The purchaser must assess if the products are fit for purpose.

3) Payment

  1. Payment or notification of payment must be made at the time of ordering.
  2. BACs payments may take up to 24 hours to process.
  3. Cheques are sent at the customer's own risk and may incur a £1.50 processing fee.
  4. Webfittings’ standard payment terms are strictly 10 days from the invoice date.
  5. We reserve the right to withdraw credit facilities at any time without notice.
  6. Interest of 2% per week may be charged on overdue accounts (31 days or more).

4) Delivery

  1. While we aim to meet requested delivery dates/times, these are not guaranteed and not the essence of the contract.
  2. The signature of any employee/person at the delivery address will be accepted as proof of delivery.
  3. If goods are refused or not accepted, the Customer will be liable for any resulting costs, including carriage, storage, or damage.

5) Loss, Damage & Returns

  1. Webfittings is not liable for any consequential or force majeure losses or damages.
  2. Claims must be made in writing within 14 days of dispatch.
  3. Returns are only accepted with prior agreement. Goods must be unused, unharmed, and in resalable condition.
  4. Bespoke or special-order items are non-returnable.
  5. Products are subject to a manufacturing tolerance of ±5%.

6) Passing of Property

  1. Goods remain the property of Webfittings until full payment is received.
  2. If goods are incorporated into other items, they remain our property until paid for in full.
  3. In cases of dispute or non-payment, Webfittings may require return of goods. If not returned, we reserve the right to enter the premises to recover them.

7) Warranty

  1. The Customer is responsible for determining if the product is suitable for their use and application.
  2. All statements or recommendations, verbal or written, are made in good faith but without guarantee.
  3. Neither Webfittings nor the manufacturer shall be liable for direct or consequential damage or loss caused by use or inability to use the product.
  4. Webfittings offers no express or implied warranties, including fitness for a particular purpose or merchantability.

8) Governing Law

The contract shall be governed by English law. The Customer submits to the jurisdiction of the courts of England and Wales.
